Which Types of Asbestos Removal Projects Are Classed as Non-Licensed?

As the Health and Safety Executive (HSE) states, to be exempt from needing a licence, the work must be:

  • Sporadic and of low intensity – to be considered as either of these things, the concentration of asbestos in the air should not exceed 0.6f/cm³ measured over 10 minutes.
  • The exposure of workers to asbestos will not exceed the legal control limit of 0.1 asbestos fibres per cubic centimetre of air (0.1f/cm³ – averaged over a four hour period).
  • A short, non-continuous maintenance task, with only non-friable materials (materials that are unlikely to release asbestos fibres when worked on or will only release a small amount).
  • An asbestos removal task where the asbestos-containing materials (ACMs) are in a reasonable condition and are not being deliberately broken up. The asbestos fibres must also be firmly contained within a matrix, e.g. the asbestos is coated, covered or contained within another material, such as cement, paint or plastic.
  • An asbestos removal task where the ACMs are in a good condition, and are either being sealed or encapsulated to ensure they are not easily damaged in the future.
  • An air monitoring and control task to check asbestos fibre concentrations in the air, or the collection and analysis of asbestos samples to confirm the presence of asbestos within a material.

Which Asbestos Products Don’t Require a License to Remove?

As the HSE stipulates, any decision on whether a particular asbestos removal project is licensable or not is based on the risk. Some non-licensable asbestos products include:

  • Asbestos cement products, e.g. roof sheets, guttering, downpipes, fascia, soffit, etc. (provided the material is carefully handled or removed without breaking up, i.e. work with asbestos cement that is weathered but not otherwise substantially damaged).
  • Small areas of textured decorative asbestos coatings using suitable dust-reducing methods, e.g. to support the installation or replacement of smoke alarms and light fittings. (Provided this can be done without deterioration of the material).
  • Loosely fixed Asbestos Insulating Board (AIB) panels in order to gain access to areas for other maintenance activities, e.g. under a bath to carry out pipework maintenance, or for access to a ceiling void for the repair of lighting. This includes re-attaching the AIB asbestos panels once the work is complete.
  • An AIB asbestos door panel with asbestos fire proofing.
