On the 10th of November 2025, the Health and Safety Executive (HSE) launched a consultation on proposals to improve the implementation of the Control of Asbestos Regulations (CAR, 2012), as well as the general guidelines regarding asbestos management, to better protect workers and building users.

These consultations cover both regulatory and non-regulatory proposals, and were open for public response. The HSE’s Science Division has provided evidence to support the proposals.

What Does the HSE’s Consultation Propose?

The HSE’s latest consultation aims to enhance health and safety risk management with three key proposals:

1. To ensure the independence and impartiality of roles in the four-stage clearance process to further minimise the risk of exposure from asbestos to workers and building users after the removal of asbestos

2. To drive up the standard of asbestos surveys to ensure dutyholders have the information they need to safely manage asbestos risks

3. To clarify the type of work that constitutes work with asbestos known as Notifiable Non-Licensed Work (NNLW)

    Who Does the Control of Asbestos Regulation Changes Affect?

    The HSE does note that certain proposals may impact certain professions more than others, but their new consultation directly affects:

    – Dutyholders

    – Asbestos analysts

    – Asbestos removal contractors (licensed and non-licensed)

    – Asbestos surveyors

    – Associated roles, e.g. facilities management and construction

      Where is the Consultation Up To?

      The consultation ran until the 9th of January 2026, and the HSE are currently reviewing responses before making a final decision (expected to be released during the first half of this year).
